This Agreement is an official and public offer of the individual entrepreneur Kulinska Maria Vasylivna, taxpayer code 3456311600, who carries out entrepreneurial activities without the status of a VAT payer (hereinafter referred to as the “Seller”), to conclude a contract for the purchase and sale of goods remotely, i.e. through an online store, in accordance with the terms and conditions set forth below.

Placing an order by the Buyer on the website kulinska-store.com means full and unconditional acceptance (acceptance) of the terms and conditions of this Agreement.

1. Subject of the Agreement

1.1. The Seller undertakes to transfer to the Buyer the ownership of the handmade decorative textile goods (placemats, napkins, runners) presented on the website, and the Buyer undertakes to accept and pay for such goods under the terms of this Agreement.

1.2. The goods can be manufactured both from stock and under individual order.

2. Ordering procedure

2.1. The Buyer places the order independently on the website kulinska-store.com by adding the goods to the cart and filling out the order form.

2.2. The Seller has the right to set minimum quantities for ordering individual categories of goods:
• placemats — from 2 pieces;
• napkins — from 2 pieces;
• runners — from 1 piece.

3. Price and payment

3.1. Prices for goods are indicated in hryvnias and are current at the time of placing the order.

3.2. The Seller reserves the right to change prices for goods depending on the cost of materials.

3.3. Payment is made in the amount of 100% of the prepayment by transferring funds to the individual entrepreneur's bank account.

Details are sent to the Buyer individually after placing the order, via messenger or SMS.

3.4. Payment through payment systems or postpaid is not provided.

4. Delivery

4.1. Delivery is carried out by the Nova Poshta service throughout Ukraine, as well as by international delivery services (except for Russia and Belarus).

4.2. The estimated delivery time of the goods is from 1 to 3 business days from the moment of order confirmation and receipt of payment (subject to availability of the goods).

4.3. The international delivery time depends on the country of destination, the selected delivery service and customs procedures. The Seller cannot guarantee the exact delivery date.

4.4. Self-pickup is not provided.

5. Terms of return and exchange

5.1. Exchange or return of goods is possible within 14 calendar days from the date of receipt of the order in accordance with the Law of Ukraine "On Protection of Consumer Rights", under the following conditions:
• the goods have not been used;
• the product appearance, packaging and labels have been preserved.

5.2. The following are not subject to return:
• individual orders (made to the Buyer's size or wishes);
• textiles that have traces of use or damage.

5.3. To process a return, the Buyer must contact the Seller via Instagram Direct, indicating the order number and reason for the request. After agreeing on the return terms, the Seller provides an address for sending the goods.

5.4. The cost of delivery is not refundable, except in cases of detected defects or errors on the part of the Seller.

6. Force Majeure

6.1. The Seller is not liable for partial or complete failure to fulfill obligations under this Agreement if this is a result of force majeure circumstances (war, state of emergency, transport blockade, other events beyond the Seller's control).

7. Other conditions

7.1. All personal data is processed in accordance with the Privacy Policy posted on the website.

7.2. The Seller reserves the right to make changes to this Agreement without prior notice by publishing the updated text on the website.

7.3. All disputes arising between the parties are resolved through negotiations. In the event of failure to reach an agreement - in accordance with the procedure provided for by the current legislation of Ukraine.


Цей договір є офіційною та публічною пропозицією фізичної особи-підприємця Кулінської Марії Василівни, код платника 3456311600, яка здійснює підприємницьку діяльність без статусу платника ПДВ (далі — «Продавець»), укласти договір купівлі-продажу товарів дистанційним способом, тобто через інтернет-магазин, згідно з нижче наведеними умовами.
Оформлення Покупцем замовлення на сайті kulinska-store.com означає повне і беззаперечне прийняття (акцепт) умов цього Договору.

1. Предмет договору
1.1. Продавець зобов’язується передати у власність Покупцеві товари декоративного текстилю ручної роботи (плейсмати, серветки, ранери), представлені на сайті, а Покупець зобов’язується прийняти та оплатити такі товари на умовах цього договору.
1.2. Товари можуть виготовлятися як зі складу, так і під індивідуальне замовлення.

2. Порядок оформлення замовлення
2.1. Замовлення оформлюється Покупцем самостійно на сайті kulinska-store.com шляхом додавання товарів до кошика та заповнення форми замовлення.
2.2. Продавець має право встановлювати мінімальні кількості для замовлення окремих категорій товарів: • плейсмати — від 2 штук; • серветки — від 2 штук; • ранери — від 1 штуки.

3. Ціна та оплата
3.1. Ціни на товари вказані в гривнях і є актуальними на момент оформлення замовлення.
3.2. Продавець залишає за собою право змінювати ціни на товари залежно від вартості матеріалів.
3.3. Оплата здійснюється у розмірі 100% передоплати шляхом переказу коштів на розрахунковий рахунок ФОП.Реквізити надсилаються Покупцеві індивідуально після оформлення замовлення, у месенджер або SMS.
3.4. Оплата через платіжні системи або післяплата не передбачені.

4. Доставка
4.1. Доставка здійснюється службою «Нова Пошта» по території України, а також міжнародними службами доставки (крім Росії та Білорусі).
4.2. Орієнтовний строк відправки товару — від 1 до 3 робочих днів з моменту підтвердження замовлення та надходження оплати (за умови наявності товару).
4.3. Термін міжнародної доставки залежить від країни призначення, обраної служби доставки та митних процедур. Точну дату доставки Продавець гарантувати не може.
4.4. Самовивіз не передбачено.

5. Умови повернення та обміну
5.1. Обмін або повернення товару можливе протягом 14 календарних днів з моменту отримання замовлення згідно з Законом України «Про захист прав споживачів», за таких умов: • товар не був у використанні; • збережено товарний вигляд, упаковку та етикетки.
5.2. Не підлягають поверненню: • індивідуальні замовлення (виготовлені за розмірами чи побажаннями Покупця); • текстиль, що має сліди використання або пошкодження.
5.3. Для оформлення повернення Покупець повинен звернутися до Продавця через Instagram-директ, вказавши номер замовлення та причину звернення. Після погодження умов повернення Продавець надає адресу для відправлення товару.
5.4. Вартість доставки не відшкодовується, окрім випадків виявленого браку або помилки з боку Продавця.

6. Форс-мажор
6.1. Продавець не несе відповідальності за часткове або повне невиконання зобов’язань за цим Договором, якщо це стало наслідком форс-мажорних обставин (війна, надзвичайний стан, блокування транспорту, інші події, що знаходяться поза контролем Продавця).

7. Інші умови
7.1. Усі персональні дані обробляються відповідно до Політики конфіденційності, розміщеної на сайті.
7.2. Продавець залишає за собою право вносити зміни до цього Договору без попереднього повідомлення, публікуючи оновлений текст на сайті.
7.3. Усі спори, що виникають між сторонами, вирішуються шляхом переговорів. У разі недосягнення згоди — у порядку, передбаченому чинним законодавством України.
